Terms of service
These terms govern the CruxTape daily plan pilot ("the pilot"): the daily plan, open update and review we send to the traders we accept as testers. The pilot is run by Thoreon Limited ("we", "us"). Taking part in the pilot means agreeing to these terms. Applying, or joining the waitlist, does not bind you to them.
1. What the pilot is, and is not
- The plan, ready by 08:50 ET, describes the previous ES session, the overnight session and where the new session is opening, and names which of five rule-defined setups can apply that day, each with a record of how it resolved in past sessions.
- The open update, on your page by 09:45 ET, states where the session opened and which setups are in play.
- The review, ready by 16:30 ET, states what each setup did that session under its rule, keeps your running tally, and lists the session's references.
The pilot runs for two weeks (ten sessions) and is free. Everything in it is general and the same for every tester. It is not investment, trading, financial, legal or tax advice. We do not know your circumstances, and nothing in the pilot is tailored to them. We do not recommend trades, forecast prices, manage accounts or place orders. You make your own decisions and are responsible for them. Read the risk disclosure before you take part.
2. Eligibility
You must be at least 18 and able to form a binding contract. You may not take part where the law prohibits it or if you are subject to trade sanctions.
3. What we ask of testers
- Open the plan and the review each session.
- Answer the one question at the end of each review.
- You can stop at any time by telling us; nothing is owed either way.
4. Your link and the content
- Each tester gets a personal link. It is for you alone: do not share it.
- The plan and the review contain market prices and figures derived from exchange data. They are for your personal use during the pilot. Do not forward, republish or share them, or the figures in them, with anyone else.
- We own the plan, the review and their wording. Taking part gives you no licence beyond reading them for your own use.
5. No charge during the pilot
The pilot is free, and we never ask for payment details during it. Nothing is charged to you until you agree to a price at checkout.
6. Changes, missed sessions and ending the pilot
We may change the content or format during the pilot. If the data for a session is incomplete, the affected section says so and is left out. If something fails, a plan or a review can arrive late or not at all. We may end the pilot, or your place in it, at any time.
7. No guarantees
The pilot is provided "as is". We work to apply each published rule exactly, but we do not guarantee that the plan or the review is complete, on time or error-free. They are built from exchange data delayed by about ten minutes, and they depend on the quality of that data. Past frequencies do not indicate future results.
8. Limitation of liability
To the extent the law allows, we are not liable for trading losses, lost profits or indirect loss arising from your use of the pilot. Our total liability to you is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.
9. Suspending or deleting your account
Your account is your email address on our waitlist or in the pilot, your personal link, and the records we keep with them.
- You can stop taking part at any time, and you can ask us to delete your account.
- We may suspend or delete any account at any time, with or without notice. That includes an account that goes unused, an account whose holder does not answer when we contact them, and an account used in breach of these terms, for example by sharing a link or the content.
- This applies to pilot testers as much as to anyone after them.
- While an account is suspended, its emails stop and its links do not open.
- Deleting an account ends its links for good and removes its data as the privacy policy describes.
Sections 1, 4, 7 and 8 survive the end of the pilot and the deletion of an account.
10. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction.
